1. Definition of Cheap Sale Price 
Means the price of the goods which, in the course of trade or business, is indicated in any manner to be less than the price at which the goods or goods of the same description were previously supplied or offered to be supplied;

Any expression or indication whether direct or indirect, including the expression "sale", "discount", "reduction", "best buy", "best price", "special price" or "price crush" and by whatever means used or given in the course of trade or business, indicating or likely to be understood as indicating that the price at which the goods are offered is less than the price at which the goods or goods of the same description were previously supplied or offered to be supplied shall be treated as an indication that the person using the expression or giving such indication is supplying or offering to supply goods at cheap sale price.

2. Number of cheap sales allowed in a year
The total number of sales at cheap sale price allowed shall not exceed 4 times in any calendar year of which:

(a) 3 times shall be determined by the Controller; and

(b) remaining quota at the choice of the applicant.

3. Gazetted Sales of 2018
Early Year Sale : 1 February – 15 March
Mega Sale : 15 May – 31 July
Year End Sale : 1 November 2018 – 31 December 2018


4. Conditions of Cheap Sales

  • Minimum 50% of total items on sale.
  • Mininum 10% cheaper compared to previous price.
  • Display the approved cheap sale notice in the premises.
  • Description of goods & price may be displayed on electronic screen/file/folder which is easily accessible & seen by consumer.
  • Maintain true & accurate record of cheap sale price for the last 6 months in the premise.
  • Premise shall indicate the price at which the goods were previously supplied and the cheap sale price and make sure it's the lowest price for goods of the same description supplied in the same premises during the continuous period of not less than 28 days immediately preceding 3 months the date 
  • of commencement of the supply or offer to supply goods at cheap sale price.
  • Applicant must include application number, date of sales and KPDNKK logo in the advertisement.
  • Maintain a reasonable stock of goods for such purpose.
  • Do not exceed 30 days in a sale period, except gazetted sales.


5. Procedures of Cheap Sale Application

  • Submission must be done online via NJM system
  • Application shall be submitted to any nearest KPDNKK branch in the System
  • Applicant shall display the approved sale notices in the premises.

6. Exemption of Cheap Sales
These Regulations shall not apply to any person who, in the course of trade or business -
(a) reduces the price of goods where such reduction of price does not in any way indicate any comparison with any other prices;
(b) reduces the price of goods where the indication or expression relating to such reduction in price is made in compliance with any specific condition relating to the purchase of such goods;
(c) reduces the price of goods where the indication or expression relating to such reduction in price is made orally within the premises where the sale is made; or (d) reduces the price of goods where the indication or expression in relating to such reduction in price is made on perishable goods and service businesses.
